The councillors who voted out Tlokwe mayor Maphetle Maphetle were just fulfilling their responsibilities as councillors, former ANC councillor David Kham has said.

Kham said in his affidavit opposing the ANC’s bid to declare illegal the council meeting of July 2 – where Maphetle was ousted – that he and the 14 other ANC councillors who supported the ousting were not “busy with a frolic of our own” or “absconding on our mandate”, as the ANC has claimed.

The case is set to be heard by the North Gauteng High Court on Tuesday.

On the day of the council meeting earlier this month, the 14 were supposed to have attended an ANC disciplinary hearing in Mmabatho, where some of them believed they would have lost their jobs.

Only two ANC councillors attended the hearings and were given warnings, while the 14 who did not attend were summarily expelled.

The ANC claims that the council meeting was cancelled by SMS the day before and that Maphetle’s ousting was illegal as a result. The DA, however, claims the SMS cancellation of the meeting was invalid.

ANC deputy president Cyril Ramaphosa and deputy secretary-general Jessie Duarte were in Potchefstroom this week to speak to ANC leaders in a bid to defuse the situation.

Kham said he didn’t meet with Ramaphosa and Duarte, and was now preparing for the by-elections that will take place in Tlokwe soon.

The first one is scheduled for August 7, and nine more will take place on September 18.

Some of the expelled ANC councillors have previously indicated that they were planning to stand as independents.

Kham told City Press “I am moving on” and that he was not interested in joining the ANC again.

The DA is set to have a meeting today in Ikageng in Tlokwe ahead of Tuesday’s court case.

There, newly elected mayor Annette Combrink, her mayoral committee and DA councillors are set to “listen to the hopes and concerns of residents”.

They also want to discuss “the DA’s plans for governance in Tlokwe”.
