The Police had last Monday, docked one Ogbaka Azuka Theresa (37) before an Ebute-Metta Chief Magistrate’s Court, for allegedly issuing a dud cheque for N330, 000 to Chief Kessington Adebutu for payment of an apartment at No 12 Adedoyin Street, Kosofe Mile 12 Lagos.
According to the statement of offence, the defendant was alleged to have on April 20, about 9.00am at 112 Funsho Williams Avenue, Surulere Lagos within the jurisdiction of the court, issued a Diamond Bank cheque with number 26872874, valued N330, 000, to Adebutu, also known as ‘Baba Ijebu’ as rent for an apartment located at 12, Adedoyin Street, Kosofe, Mile 12, Lagos.
It was revealed that when the cheque was presented for payment, it was returned unpaid on the grounds of insufficient funds in the account of the defendant. It was stated that the payee who felt disappointed after futile efforts to get the money, reported the matter to the police.
According to Corporal Cyriacus Osuji the police prosecutor, the offence allegedly committed by the defendant contravened section 319 (b) of the criminal laws of Lagos State of Nigeria, 2011.
The defendant pleaded not guilty to the one count charge when it was read to her.
After her plea, her counsel Mr. Ola Ogunbiyi, applied to court to grant the defendant bail in the most liberal term, positing that the case is that of landlord and tenant, which ought to have been resolved amicably.
After listening to the submission of counsel to the defendant, presiding magistrate admitted the defendant to bail in the sum of N100, 000, with two sureties in the like sum.
Badejo-Okusanya also ordered that the sureties must show evidence of three years tax payment to Lagos state government, as well as means of livelihood, and must be residents of Lagos state. The matter has been adjourned till October 2, for mention.
